Terms of service

These Terms set out the rules for using Prosciej — a web application for designing furniture in 3D. By using the service, you accept these Terms.

1. General provisions

The service provider is Paweł Kazubski, trading as Prosciej (prosciej.com), with a registered address at ul. Leona Babińskiego 1, 71-051 Szczecin, Poland, tax ID (NIP) 955-215-93-41. Contact: our contact form at prosciej.com/kontakt.

The service is aimed primarily at businesses (carpenters, designers) but may also be used by consumers. Any provisions less favourable to consumers than mandatory law do not apply to them.

2. Scope of the service

Prosciej lets you design panel-based furniture in a 3D view, save projects, share them read-only, and export a cutting list with pricing (PDF) and DXF files for CNC machines. The availability of individual features depends on the selected plan (Free, Pro, Business).

Quotes and dimensions generated by the service are auxiliary. The user must independently verify dimensions, materials and costs before production — see the “Liability” section.

3. User account

Using most features requires an account (email and password or Google sign-in). The user agrees to provide accurate data and to protect login credentials against third-party access.

One account is intended for one user, unless the plan (Business) explicitly provides for team collaboration.

4. Payments and subscription

The Pro and Business plans are paid on a subscription basis (monthly or annually). Prices shown in the service are gross prices in Polish złoty. Payments are handled by an external operator, Stripe, supporting BLIK, Przelewy24 and cards, among others.

The subscription renews automatically for the next billing period unless cancelled earlier. You may cancel at any time — access to paid features remains active until the end of the paid period.

We issue VAT invoices on request based on the data provided by the user. A consumer, and a sole trader entering into a contract directly related to their business activity where the contract has no professional character for them (together, “Consumer”), has the right to withdraw from a distance contract within 14 days of concluding it, without giving a reason, under the Polish Consumer Rights Act of 30 May 2014. A withdrawal statement may be submitted in any form, e.g. through our contact form at prosciej.com/kontakt or in writing to the provider's registered address given above; a withdrawal form template is available on request. If the Consumer expressly requests that the service begin before the withdrawal period ends and then exercises the right of withdrawal, the Consumer must pay for the service performed up to the moment of withdrawal, calculated proportionally to the scope of the service provided. We refund the remaining amount paid within 14 days of receiving the withdrawal statement, using the same payment method the Consumer used, unless the Consumer expressly agrees to a different refund method that involves no additional cost to them.

5. Ownership of projects and content

All projects, dimensions and content entered by the user remain the user's property. The provider claims no rights to them and processes them solely to provide the service.

The user grants the provider a limited licence necessary to store, display and process projects (e.g. generating PDF/DXF files and thumbnails) as part of the service's operation.

Rights to the service itself, its software, trademarks and material library belong to the provider.

6. Liability

The service is provided “as is”. The provider makes every effort to keep the calculations (cutting list, quote, DXF) correct, but is not liable for design errors, material loss, or costs arising from relying solely on the service's data without verifying it.

The provider's liability towards businesses arising from use of the service is limited to the fees paid in the last 12 months. These limits do not affect consumer rights under mandatory law.

7. Termination

The user may delete the account at any time, which ends the contract. The provider may suspend or terminate an account in case of a material breach of these Terms, after first requesting that the breach stops (unless the law provides otherwise).

After termination, project data is deleted or anonymised in accordance with the Privacy Policy.

8. Changes and final provisions

The provider may amend these Terms for valid reasons (e.g. changes in law or service scope), notifying users with appropriate advance notice. Matters not regulated here are governed by Polish law. Disputes with consumers are settled by the competent common courts. Disputes with Users who are businesses are settled by the court with jurisdiction over the provider's registered seat (Sąd Rejonowy Szczecin-Centrum w Szczecinie or Sąd Okręgowy w Szczecinie, Poland, depending on the value of the claim).
